Bizarro Is Here

The story of strange happenings taking place all over the Northeast area is just too big for the Daily Planet. So you guys are going to have to help me out in my investigation of the story.

In return, I've set up a deal with Six Flags. People who submit the bizarre videos or pics of strange incidents will get to go to "Preview Day" for free*, and check out the new Bizarro coasters at Six Flags Great Adventure or Six Flags New England before anyone else!

Here's how it works -- if you can find any strange, odd, or abnormal activities around you, record them. Use a video camera or a regular camera. Usually it's things that are just the opposite of what they should be -- dogs feeding their masters. Snow in the summer. Garbage trucks that take garbage to homes and spill the trash on the street. Or just things that are a little twisted, weird, or out of the ordinary.

If your video or pic is strange enough, we'll post it here -- and you could be one of the first to ride the all-new Bizarro rides.

AFFIDAVIT OF ELIGIBILITY/LIABILITY AND PUBLICITY RELEASE

I am submitting this Affidavit with the understanding that it will be relied upon to determine my eligibility to enter, participate in, and receive any prize in, the "Bizarro Event." I affirm and represent that I am age 18 or over, that I have read, understood and complied with, and will continue to comply with, all of the Terms & Conditions for the "Bizarro Event" (a copy of which are available at [BizarroIsHere.com], which shall be binding on me.  I further represent that I meet all eligibility requirements and that I have not perpetrated (and will not perpetrate) any fraud or deception in entering or participating in the "Bizarro Event," or in claiming any prize that may be awarded to me.

I represent that the video or image submission (and all components of the submission), including, without limitation, all contents, concepts and ideas embodied therein, are the exclusive property of Six Flags, Inc.  I hereby irrevocably grant to Six Flags, Inc., and its subsidiaries, affiliates, successors and assigns, all right, title and interest in and to the video or image submission, including, without limitation, all intellectual property and other proprietary rights without expectation of compensation or acknowledgement.  I agree that Six Flags, Inc. and its subsidiaries, affiliates, successors, assigns, licensees and designees shall each have the perpetual, irrevocable, world-wide and fully-transferable right (but not any obligation) to use, modify, display, reproduce, make derivative works of, and otherwise exploit the video or image submission (or any part thereof) and my participation therein for promotional purposes in any manner or media whether now or hereafter existing and/or to otherwise use or commercially exploit the video or image submission (or any part thereof) and my participation therein, or information or ideas contained within the video or image submission, all without further payment, consideration, attribution, notice or consent.  Six Flags, Inc. does not have any obligation to maintain the video or image submission, or any information or ideas contained therein, as confidential or proprietary.  Six Flags, Inc. reserves the right to edit, modify, or abridge the video or image submission for any reason prior to use.

Except where prohibited by law, I hereby irrevocably grant to Six Flags, Inc. and its subsidiaries, affiliates, successors, assigns and designees, the absolute right and permission to use my name, biography, likeness, voice, photographs, hometown and state for promotional purposes in any manner or media whether now existing or hereafter created (including, without limitation, online), worldwide, in perpetuity, without notice to me and without limitation, condition, consideration, consent or compensation.  I shall have no right of approval, no claim to any compensation, and no claim arising out of the use, alteration, distortion or illusionary effect or use in any composite form of any of the foregoing attributes of my identity.

I represent that the video or image submission has been originally and lawfully created by me or with my permission and the use, modification, play or reproduction of the video or image by Six Flags, Inc. or will not give rise to any third party claims for infringement or violation of copyright, trademark or any other right of any third party, or to any third party claims including libel, defamation, violation of privacy or breach of contract.  I have obtained all the necessary permissions, consents, licenses or other approvals of third parties necessary or appropriate for the preparation or use of the video or image by Six Flags, Inc. or its affiliates.

I hereby forever and irrevocably RELEASE, DISCHARGE, INDEMNIFY AND HOLD HARMLESS, Six Flags, Inc. and its subsidiaries (and their respective affiliates, advertising or promotion agencies), and the employees, officers, directors, shareholders, representatives, agents and insurers of each of them (collectively, the "Releasees"), from and against all losses, claims, damages, liabilities, costs or expenses (collectively, "Losses"), arising in whole or in part, directly or indirectly, from my entry and/or participation in the "Bizarro Event," the preparation or use of the video or image, and my receipt or use of any prize awarded to me, including, but not limited to, any Losses caused or alleged to be CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE of any Releasee.  The foregoing release includes, without limitation, any and all LIABILITY, BODILY INJURY, DEATH, LOSS OR DAMAGE to myself or any third party arising in whole or in part, directly or indirectly, from any prize or the use of any prize; the award, acceptance, possession, use or misuse of any prize; and participation in the "Bizarro Event," or any prize activities.  I further COVENANT NOT TO SUE any of the Releasees with respect to any matter addressed by this release.

I HAVE READ THIS RELEASE, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO IT AND HAVE AGREED FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.

I understand that I will be disqualified from receiving and agree to return to Six Flags, Inc. any prize which may be awarded to me if any statement made by me in or documentation furnished by me with this Affidavit is false and I agree to return immediately upon demand to Six Flags, Inc. any prize or the cash value of such prize which has been or may be awarded to me if any statement made by me in this Affidavit or documentation furnished by me with this Affidavit is false.

I acknowledge and agree that I have read this Affidavit, including the above publicity and liability release prior to its execution, and that I fully understand its contents.

I acknowledge and agree that no Releasee has made or in any manner is responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, related to the prizes.

It is understood and agreed that this is a complete RELEASE and DISCHARGE of all claims and rights of the undersigned against the Releasees and that no action will be taken by or on behalf of the undersigned with respect to any such claims and rights, it being understood that this Affidavit and its terms shall be binding upon the undersigned, and his/her successors, assignees, subrogors, insurers, heirs, next of kin, executors, representatives, and legal and personal representatives.  I will not make any attempt to rescind, limit or disaffirm this Affidavit or any portion hereof.

No statements regarding the effect of this Affidavit, not contained in this Affidavit, shall modify the terms of the Affidavit.  If any portion of this Affidavit is later found to be invalid, the portion in question shall be enforceable to the greatest extent permitted by law and the balance of this Affidavit shall continue in full force and effect.  In any proceeding or other attempt to enforce, construe or to determine the validity of this Affidavit, the nonprevailing party will pay the reasonable expenses of the prevailing party, including, without limitation, reasonable attorneys' fees and costs.  This Affidavit shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of laws principles.  Sole and exclusive jurisdiction and venue for any dispute concerning this Affidavit shall be in the federal or state courts located in New York, New York, and I hereby submit to sole and exclusive personal jurisdiction in the State of New York for any such dispute and irrevocably waive any and all rights to object to such jurisdiction.  I agree and understand that any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering the "Bizarro Event" but in no event attorneys' fees, and under no circumstances will I be permitted to obtain awards for and I hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY.
